Terms of Service

By creating an account or otherwise using BiomarkersIQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, whichever is greater, to use BiomarkersIQ. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@biomarkersiq.com if you suspect unauthorized use.

You agree not to:

• Use the Service for unlawful purposes
• Attempt to reverse engineer, scrape, or disrupt the Service
• Upload malicious code or infringing content
• Impersonate another person or misrepresent your affiliation
• Use the Service to provide medical advice to third parties

You retain ownership of health data, files, notes, and feedback you submit ("Your Content"). You grant BiomarkersIQ a limited, non-exclusive license to process Your Content solely to operate and improve the Service for you.

When you connect a third-party account (Apple Health, Garmin, WHOOP, Oura, MacroFactor, Fitbit, and others as available), you authorize BiomarkersIQ to access and process the data those providers make available to us. You may revoke this access at any time from within the app or from the third-party provider.

BiomarkersIQ uses AI to generate briefings, patterns, and recommendations. These outputs may be incomplete, inaccurate, or unsuitable for your situation. You are solely responsible for evaluating them and remain responsible for your own healthcare decisions. BiomarkersIQ is not practicing medicine.

BiomarkersIQ provides informational wellness insights only. It is not intended to diagnose, treat, cure, or prevent any disease and does not replace advice from a qualified healthcare professional.

The Service, including its software, design, models, and content (excluding Your Content), is owned by BiomarkersIQ and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.

Some features may be offered on a paid or subscription basis in the future. If you subscribe, you authorize us (or our payment processor) to charge the payment method on file according to the plan you select. Subscriptions renew automatically unless cancelled before the renewal date, and fees are non-refundable except where required by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOMARKERSIQ AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm to us, other users, or third parties.

These Terms are governed by the laws of the jurisdiction in which BiomarkersIQ is established, without regard to its conflict-of-laws principles. Disputes will be resolved in the courts located in that jurisdiction, unless local law requires otherwise.

We may update these Terms from time to time. Material changes will be communicated in the app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
